Co-ownership reform in Morocco (draft law 30-24): what changes and what already applies

October 13, 20267 min read

Co-ownership in Morocco is governed by law 18-00 on the status of co-owned buildings (2002), amended by law 106-12 (2016). Draft law No. 30-24, which amends and supplements law 18-00, was adopted by the House of Representatives on 9 July 2024. Before relying on it, check that it has been published in the Official Bulletin: only the published text is authoritative.

Several measures often presented as new are in fact already in law 18-00: an attempt at an amicable settlement before going to court, the right of co-owners to convene the general assembly when the syndic fails to, and prompt notification of the assembly's decisions. The reform mainly aims to professionalise syndics and strengthen the transparency of accounts.

Conciliation before any court action: for unpaid charges, unauthorised works or misuse of common areas, the syndic must be able to show that an amicable settlement was attempted first. In practice, keep a dated record of every reminder, the formal notice and the co-owner's replies: this file is what the court will ask for.

Assembly convened by co-owners: when the syndic does not organise the assembly, co-owners can convene it themselves, with the mandatory details (date, time, place, agenda) and the notice period set by law.

Minutes sent promptly: the minutes must be notified to each co-owner shortly after the assembly (practitioners use 8 days). This notification starts the period for challenging decisions: keep proof of delivery to each co-owner, especially those who were absent.

Accountability: the funds of the co-owners' association must remain separate from the syndic's own assets, accounts are presented to the general assembly, and each co-owner must be able to access the financial information that concerns them.

In SyndicHubs, these obligations are covered day to day: each charge keeps a dated history of its reminders, every action is recorded in the audit log, the notice and minutes of the assembly are generated and then published in each resident's portal with a notification, announcements show who has read them, and accounts are kept separately for each building, with an annual management report.
