Guide: Rights and obligations of the syndic
The condominium syndic is the legal representative of the co-owners' syndicate. As such, they have rights and obligations strictly defined by law to ensure the proper management of the building.
Their main obligations include executing the decisions of the general assembly, administering the building, its conservation, guardianship, and maintenance. In case of emergency, they must proceed on their own initiative to execute any work necessary to safeguard the building.
The syndic is also responsible for financial management. They establish the provisional budget, keep the syndicate's accounts, collect fees from co-owners, and pay suppliers.
In administrative matters, they must keep the list of co-owners up to date, convene and lead general assemblies, and write minutes. They represent the syndicate in all civil acts and in court.
In return for these responsibilities, the syndic has rights. If professional, they have the right to remuneration set by contract and approved by the general assembly. They also have the right to be reimbursed for expenses incurred for the condominium.
Failure to comply with their obligations incurs the civil, and even criminal, liability of the syndic. This is why the use of professional management tools is strongly recommended to avoid errors and guarantee transparent management.
